Language to Include in a Contract

SELL PROPERTY AS PART OF A TAX DEFERRED EXCHANGE

Seller reserves the right to structure this transaction as a Tax Deferred Exchange under IRC § 1031, at no cost, liability or time delay to Buyer. Buyer agrees to an assignment of this contract to Seller’s Qualified Intermediary required by Seller’s Tax Deferred Exchange and also agrees to sign exchange documents as reasonably necessary.

PURCHASE REPLACEMENT PROPERTY

Buyer is purchasing this property as part of an IRC § 1031 Tax Deferred Exchange, at no cost, liability or time delay to Seller. Seller agrees to an assignment of this contract to Buyer’s Qualified Intermediary required by Seller’s Tax Deferred Exchange, and also agrees to sign exchange documents as reasonably necessary.
